According to the Supreme Court a man who gives instance talaq on his wife will be punished with a jail term and a fine. This Bill also makes the declaration of talaq-e-biddat a non-bailable offence.
NEW DELHI: The issue of Talaq or divorce is one of the most important issues in the lives of people, not only in India, but all over the world. But in other parts of the world, it is not as contentious as it has been made in India.
Today is the last day of the Monsoon Session of Parliament and the government could introduce amendments in Rajya Sabha. If the bill is cleared by the upper house, it will have to go back to Lok Sabha for approval of the amendments.
Law Minister Ravi Shankar Prasad said that the Union Cabinet has approved three amendments to the ‘Muslim Women Protection of Rights on Marriage Bill’ which has been cleared by Lok Sabha and pending approval of Rajya Sabha.
The government is also expected to introduce the Triple Talaq bill in Parliament on Friday. The Union Cabinet has made changes in the proposed bill conceding to opposition demands on registering complaints and on provision for arrest.
The first change allows only a woman, or a close relative, to file a police case against her husband for instant triple talaq, the Islamic practice that allows men to divorce their wives immediately by uttering the word “talaq” thrice.
The second amendment allows her to drop the case if the husband comes around later and they arrive at a compromise.
A third amendment mandates that the magistrate can decide on releasing the husband on bail only after hearing the wife.The ruling BJP has already ordered all its lawmakers to be present in the Rajya Sabha in full strength, just in case.
Now, it will be interesting to see that what emerges in near future. Will this law will help in curbing this menace or it create a new kind of Pandora’s Box of problems?
